Inspired Creations Dance Studio
WAIVER AND RELEASE OF LIABILITY
I/we realize that dancing is a physical activity and participation in dance classes and activities, despite precautions, could involve some possible personal injury. I agree that my/my child's participation in Inspired Creations Dance Studio LLC involves inherent physical risks and I agree to assume the full risk of any bodily injuries (including death), damages, or loss which I/my child may sustain as a result of any activities arising out of, connected with, or in any way associated with my/my child's participation in Inspired Creations Dance Studio LLC activities. I certify that my/my child's present level of physical condition is consistent with the demands of active participation in dance. In the event that I/my child should require medical care or treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
By signing this release form, I/we (the dancer and parent/guardian) assume all risks related to the use of any and all spaces used by Inspired Creations Dance Studio LLC. I/we agree to release and hold harmless Inspired Creations Dance Studio LLC including its owners, teachers, dancers, staff members, and facilities used by both entities from any cause of action, claims, or demands now and in the future. I/we will not hold Inspired Creations Dance Studio LLC liable for any personal injury or any personal property damage, which may occur on the premises before, during or after classes.
I understand that appropriate physical contact is required during the instruction of dance, and I give permission for instructors to make appropriate physical contact with me or my child for such instruction.
I/we agree to obey the class and facility rules and take full responsibility for my/our behavior in addition to any damage I/we may cause to the facilities utilized by Inspired Creations Dance Studio LLC. In the event that any damage to equipment or facilities occurs as a result of my or my family's willful actions, neglect or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
In consideration of the risk of injury while participating in dance (the "Activity"), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my/my child’s participation in the Activity, and do hereby release and forever discharge Inspired Creations Dance Studio LLC, located at 1121 E Grand River Ave, Howell, Michigan 48843, their instructors, contractors, employees, affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, for any physical or psychological injury, including but not limited to illness, paralysis, death, damages, economical or emotional loss, that I/my child may suffer as a direct result of my participation in the aforementioned Activity, including traveling to and from an event related to this Activity.
I AM/MY CHILD IS VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED ACTIVITY AND I AM/MY CHILD IS PARTICIPATING IN THE ACTIVITY ENTIRELY AT MY/MY CHILD’S OWN RISK. I am/we are aware of the risks associated with traveling to and from as well as participating in this activity, which may include, but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and death. I/we understand that these injuries or outcomes may arise from my/my child’s own negligence, conditions related to travel, or the condition of the activity location(s). Nonetheless, I/we assume all related risks, both known or unknown to me/my child, of my/my child’s participation in this activity, including travel to, from and during this activity.
I/we agree to indemnify and hold harmless Inspired Creations Dance Studio LLC against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my/my child’s behalf, including attorney's fees and any related costs, if litigation arises pursuant to any claims made by me/my child or by anyone else acting on my/my child’s behalf. If Inspired Creations Dance Studio LLC incurs any of these types of expenses, I agree to reimburse Inspired Creations Dance Studio LLC.
I acknowledge that Inspired Creations Dance Studio LLC and their directors, officers, volunteers, representatives and agents are not responsible for errors, omissions, acts or failures to act of any party or entity conducting a specific event or activity on behalf of Inspired Creations Dance Studio LLC.
I/WE ACKNOWLEDGE THAT THIS ACTIVITY MAY INVOLVE A TEST OF A PERSON'S PHYSICAL AND MENTAL LIMITS AND MAY CARRY WITH IT THE POTENTIAL FOR DEATH, SERIOUS INJURY, AND PROPERTY LOSS. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, condition of participants, equipment, vehicular traffic and actions of others, including but not limited to, participants, volunteers, spectators, coaches, event officials and event monitors, and/or producers of the event.
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS "WAIVER AND RELEASE" AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I expressly agree to release and discharge Inspired Creations Dance Studio LLC and all of its instructors, contractors, employees, affiliates, manageers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I otherwise have to bring legal action against Inspired Creations Dance Studio LLC for personal injury or property damage.
To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of Inspired Creations Dance Studio LLC, its agents, and employees.
This Agreement was entered into at arm's-length, without duress or coercion, and is to be interpreted as an agreement between two parties of equal bargaining strength. Both the Participant(s) and Inspired Creations Dance Studio LLC agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.
In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase or portion of this agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this agreement shall remain in full force and effect, so long as the clause severed does not affect the intent of the parties. If a court should find that any provision of this agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.
WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19
In consideration of being allowed to participate on behalf of Inspired Creations Dance Studio LLC and the related events and activities, the undersigned acknowledges, appreciates, and agrees that:
MEDICAL EMERGENCY
I grant permission to the staff of Inspired Creations Dance Studio LLC to take first aid or emergency measures as judged necessary for the care and protection of my child while under the supervision of the studio. In case of a medical emergency, I understand that my child will be transported to an appropriate medical facility by the local emergency unit for treatment if the emergency unit deems it necessary. I understand that in some medical situations the staff will need to contact the emergency resource before the child's parent, physician, and or other person acting on the parent's behalf. I also understand and agree that the child's parents or legal guardians shall be responsible for any expenses incurred.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND SIGN IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

WAIVER/RELEASE FOR COMMUNICABLE DISEASES INCLUDING COVID-19
In consideration of being allowed to participate on behalf of Inspired Creations Dance Studio LLC and the related events and activities, the undersigned acknowledges, appreciates, and agrees that:
- Participation includes possible exposure to and illness from infectious diseases including but not limited to MRSA, influenza, and COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist; and,
- I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation; and,
- I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against infectious diseases. If, however, I observe and any unusual or significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the dance studio owner; and,
- I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS Inspired Creations Dance Studio LLC, their instructors, contractors, employees, affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns, and if applicable, owners and lessors of premises used to conduct the event (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
